PROBATE - ESTIMATES OF COSTS

An estimate of time required to complete any probate administration is dictated by many factors relating to the size and complexity of an estate An average costs estimate would therefore be in the region of £2,000.00 - £3,500.00 plus VAT.

If we are instructed to obtain a Grant of Probate or Letters of Administration :

If we are instructed to obtain a Grant of Probate or Letters of Administration (with or without Will annexed) and administer an estate, we will charge a value element in addition to our hourly charging rate based on 1% of the gross (pre-tax) value of the estate plus VAT. The value of any residential property contained in the estate will be reduced by 50% when calculating the gross value of the estate. Where directors of this firm are appointed as Executors the value element will be based on 1.5% of the gross (pre-tax) value of the estate plus VAT. The value element charge reflects the risk and responsibility to the firm for the conduct of the matter.

As a broad estimate we anticipate that if there is for example one beneficiary and no property this will take between 6 to 12 hours of work and probate administration normally takes between 6 to 12 months to complete at £150.00 - £250.00 plus VAT per hour.

Probate administration with for example one beneficiary, no property and few bank accounts will likely be at the lower end and by contrast if there are multiple beneficiaries, property, multiple bank accounts, share dealings then costs will likely be higher.

An example of an estate which would fall within the range of our estimate is as follows:

  • • There is a valid Will.
  • • No more than one property.
  • • No more than 3 bank/building society accounts.
  • • There are no share dealings required.
  • • There are no other intangible assets.
  • • There are no likely disputes between beneficiaries and division of assets.
  • • There is no Inheritance Tax payable and the executors do not need to submit a full account to HMRC.
  • • There are no claims made against the estate.

Disbursements

Disbursements are costs related to your matter that are payable to third parties such as court fees. We will handle the payment of disbursements as part of the administration process.

Potential additional costs

  • • Advertising for estate creditors (if required) £150.00 plus VAT.
  • • If there is no Will or the estate consists of any share holdings (stocks and bonds) there is likely to be additional costs that could range significantly depending on the estate and how it is to be dealt with. We can give you a more accurate estimate once we have more information.
  • • Oath Fees (£5.00 per executor with an additional £2 per executor per Will or codicil)
  • • Probate Court fee presently £155.00 but likely to increase in 2019.
  • • Bankruptcy Search for Estate Beneficiaries £2.00 plus VAT per person.
  • • Conducting a Will search (if required). This cost can vary between £45.00 - £238.00 depending on the search opted for.
  • • Obtaining new death certificates (approximately £10.00 to £25.00).
  • • If any additional copies of the Grant are required, they will cost £0.50.
  • • Dealing with the sale or transfer of property is not included but we can quote separately for any sale on behalf of the estate using our online conveyancing calculator or by direct quotation.
  • • Property insurance costs (vary depending on the value of the property)
  • • Land Registry Office Copy Entry fee (if required) £3 plus VAT per property.
  • • Land Registry fees (from £20.00 dependent upon the value of the property plus VAT if applicable).
  • • Statutory Declaration (approximately £7.00 per person per document, if required).

What is included?

  • • Obtain details of all assets and liabilities.
  • • Obtain valuations of properties and investments as necessary.
  • • Provide a beneficiary pack to all legatees and beneficiaries.
  • • Carry out identity checks and bankruptcy searches of all legatees and beneficiaries.
  • • Arrange statutory notices if required.
  • • Preparation of HM Revenue and Customs forms.
  • • Preparation of the Oath.
  • • Lodge the Oath with the Probate Registry.
  • • Collect in all assets and make payment of debts and legacies.
  • • Arrange to make interim payments as appropriate to beneficiaries.
  • • Preparation of final estate accounts and submitting them to personal representatives for approval.
  • • Distribute to residuary beneficiaries their entitlement.

What is not included?

  • • The conveyancing of a sale of a property.
  • • Clearance of a property.
  • • Any dispute or litigious matters.
  • • Dealing with missing items or beneficiaries.
  • • Dealing with assets that fall outside the estate for example, trust assets or life policies.
  • • Advice in connection with deeds of variation.
  • • Setting up or disbanding of any trusts created by the Will or intestacy.
  • • Investigation of Benefits Agency claims.

Grant Only

If you require us to obtain a Grant of Probate only then a fixed fee of £500.00 plus VAT is charged together with the disbursements as listed above where applicable.

What is included?

  • • Advise you on the notices which may be given to reduce your liabilities as executor.
  • • Advise you on how to ascertain the correct figures for the deceased’s accounts and savings for probate purposes.
  • • Complete the relevant HMRC inheritance tax return.
  • • Draft an Oath for the executors/administrators to swear.
  • • Apply to the court for a Grant of Probate/Letters of Administration.
  • • Deal with any queries the Probate Registry has.
  • • Provide official copies of the Grant to you.

Where executors choose to use our Grant Only service, they can upgrade to the Full Administration package at any time after we have been instructed. From that point we can take over the administration process at our agreed hourly rate.
